NYC Department of Sanitation Information Sessions on New Set-Out Rules for Commercial Trash

Effective on Saturday, April 1 there will be new rules regarding how businesses in NYC can put out their trash for pickup by their private carter.  Currently, you can place your trash directly out on the sidewalk in front of your business for pickup by your carter within one hour of your store's closing time. As of April 1, you must either:

  • Place waste out after 8:00 PM if putting bags directly on the curb for pickup that evening; or
  • Place waste out one hour before closing in a secure container with a tight-fitting lid. Bundled cardboard may go next to the container.

Not complying with these could result in fines of $50 for a first offense, $100 for a second offense, and $200 for third and subsequent offenses within a 12-month period. There will not be a grace period or warning period; enforcement begins April 1. If your business closes before 8:00 PM, you will most likely need to obtain trash containers, and find a location in your store/building to store these trash containers. This will certainly pose some logistical challenges, so we urge you to engage in this issue as soon as possible.

As a reminder, if you own a store or a commercial business, you must hire a private carter to collect your trash and recyclables. It is unlawful to place your trash in or alongside a corner NYC trash can.
